Verdict imminent in Vermont murder trial

BURLINGTON— A verdict in the murder trial of Donald Fell could come as early as this afternoon. On Thursday, federal prosecutors wrapped up their case, and U.S. District Judge William Sessions asked lawyers for both sides about the legal questions apt to be raised during the penalty phase.
Although lawyers for Donald Fell have admitted that he participated in the murder of 53-year-old Terry King in November 2000, they have not challenged much of the prosecutions’ evidence.
Fell’s controversial trial in U.S. District Court has focused on a painstaking prosecution review of the physical evidence developed when police and FBI investigators discovered the victim’s body in Dover, NY.
A quick verdict is expected. During the penalty phase, which could take longer than the proceedings so far, the defense plans to bring in expert witnesses. Sessions has yet to rule on how much evidence can be introduced about Fell’s abuse and environment as a child.
